Cascio Calogero hereby grants you a limited, non-exclusive, non-transferable license to download, install and use the AISistant mobile application (the “App”) on any Apple-branded products that you own or control, as intended and permitted by the App’s usage rules set forth in the App Store Terms of Service.
This license does not allow you to use the App on any Apple-branded products that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the App. You may not copy (except as expressly permitted by this license and the App Store Terms of Service), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the App). Any attempt to do so is a violation of the rights of Cascio Calogero and its licensors. If you breach this restriction, you may be subject to prosecution and damages.
The terms of this license will govern any upgrades provided by Cascio Calogero that replace and/or supplement the original App, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.
This license does not grant you any rights to use the trademarks or other proprietary content of Cascio Calogero, including the App’s name, logos and other brand elements, or to use the software or services of OpenAI, which are used under license by Cascio Calogero to provide the App’s features.
The App is provided “AS IS” without warranty of any kind, either express or implied, including without limitation any implied warranties of condition, uninterrupted use, merchantability, fitness for a particular purpose, or non-infringement. Cascio Calogero makes no warranty as to the accuracy, completeness, or reliability of any content available through the App.
You are solely responsible for any damage to your device or loss of data that may result from using the App. Under no circumstances shall Cascio Calogero be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use the App or the content thereof.
Cascio Calogero may terminate this license at any time for any reason, or no reason. Upon termination, you must cease all use of the App and delete all copies of the App in your possession.
This license is governed by the laws of the Country of residence of Cascio Calogero. Any disputes arising under or in connection with this license shall be resolved by the courts of the Country of residence of Cascio Calogero.
By using the App, you confirm that you have read and understand this license and agree to be bound by its terms and conditions.
